Introductory consultations
Booking an introductory consultation does not create a payment obligation or commission a website project.
2. User Responsibilities
You agree to provide accurate information and materials required for your project. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account
3. Payments
A deposit of 50% of the agreed project fee is payable before work begins. A lower deposit or payment in instalments is available only if agreed in writing in advance. The remaining balance is invoiced after delivery and completion of the agreed revisions. The payment deadline is stated in the quotation or invoice. Additional work requires separate approval of its scope and cost before it begins.
If payment remains outstanding after delivery and completion of the agreed revisions, Fast Digital Services may refer the unpaid amount to a collection agency after the payment deadline and any legally required notices. Statutory interest and collection costs apply only where permitted by law. Before collection costs become payable, consumers receive a free payment notice allowing 14 days from the day after receipt to pay and stating the applicable collection costs.
4. Hosting & 99% Uptime Guarantee
If you choose hosting via Fast Digital Services, we guarantee 99% online availability on an annual basis. This excludes scheduled maintenance, disruptions caused by third parties or the client, and force majeure situations. If downtime exceeds the guarantee, reasonable compensation will be offered.
5. Intellectual Property
Ownership of deliverables transfers upon full payment. All designs, code, and materials remain property of Fast Digital Services until full payment is made.
After their public launch, completed websites are included in the Projects portfolio on the Fast Digital Services website. Fast Digital Services may showcase the project with a description, screenshots, the business name, logo and a link to the website. The client grants permission to the extent that they hold the necessary rights. Confidential information will not be published; third-party rights and applicable privacy rules remain in force.
6. Prohibited Activities
Users may not use our services for illegal or unauthorized purposes. Copying, modifying, or distributing Fast Digital Services’ intellectual property without permission is prohibited.
7. Limitation of Liability
Fast Digital Services is not liable for indirect, incidental, or consequential damages, including but not limited to loss of profit, reputational damage, or client misuse.
8. Termination
We reserve the right to terminate services if the client breaches these terms. Maintenance contracts may be terminated monthly or annually with one month’s notice. Outstanding fees remain payable upon termination.
9. Privacy & Data Processing
Fast Digital Services processes personal data in accordance with the GDPR. A data processing agreement can be concluded for specific processing activities.
10. Amendments
Fast Digital Services may update these terms periodically. Continued use of our services after updates constitutes acceptance of the revised terms
11. Governing Law and Disputes
These Terms of Service are governed by Dutch law. Disputes will be submitted to the competent court in the district where Fast Digital Services is established.
